As a destructive social phenomenon, civil wars produce extensive political, social, economic, and identity crises. These conflicts have been accompanied by systematic violations of citizens’ rights and have led to forced migrations, intensified social violence, sexual abuse, child soldiering, and the instrumentalization of civilians. Given the spread of civil wars in Muslim countries and their vast human consequences, as well as victims’ deprivation of access to justice and compensation, this study examines the evolution of protection for victims of civil wars within the Islamic legal system using a historical-analytical approach and library sources. The findings show that protecting innocent citizens is one of the exalted values of Islamic sharia and an important objective of the Islamic legal order, emphasized even at the height of armed conflicts. The provisions protecting victims of civil wars among Muslims have their roots in the Qur’an and the conduct of the Prophet (peace be upon him). After him, these provisions were attended to by the caliphs and especially by Imam Ali and the other Imams of the Ahl al-Bayt. Since the earliest periods of Islamic jurisprudence, these rules and regulations have been a concern of jurists and have expanded in the modern era with the articulation of Islamic humanitarian law. Reexamining this rich legal heritage can pave the way for designing a comprehensive legal, financial, psychological, and medical support system for victims of contemporary civil wars.
