Today, travel and tourism are considered one of the basic needs in modern global culture that has significant impacts on the economy and trade of different countries. For this reason, countries are trying to develop their tourism industry and attract foreign tourists. This not only contributes to economic growth, but also makes the need to recognize and guarantee the rights of tourists in the domestic laws of countries inevitable. The purpose of this research is to examine the rights of foreign tourists in the laws of Afghanistan and tries to analyze the general rights of tourists in the legal system of Afghanistan using a descriptive analytical method. The main question of the research is "What is the status of the rights of foreign tourists in Afghanistan and how do the domestic laws of this country recognize these rights?" The research findings show that according to the Constitution of Afghanistan, the rights of foreign tourists such as personal and financial security, the right to travel, the right to choose their residence, and the right to access consulates and courts are recognized internationally. On the other hand, tourists are also obliged to respect the laws and internal cultures of Afghanistan so as not to conflict with moral and social principles.
